Please read the following terms and conditions carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that apply to your purchases. The use of this site is governed by the policies, terms and conditions set forth below.

 

Digital Peripheral Solutions Inc accepts Domestic American Express, Visa, Discover and MasterCard for shipments to U.S addresses only. The billing address MUST be exactly as it appears on your credit card statement, or your shipment will be delayed. You are the authorized owner of this Credit Card. We will authorize the amount of the order against your credit card when the order is placed. You will then be billed when the order is shipped. By placing the order, you are recognizing that the order cannot be revised, and is good to ship. Credit card orders cannot be changed by our sales reps. Orders can only be cancelled if they have not shipped.

 

Terms and Conditions
The following terms and conditions govern your use of this Site and the purchase of products by you through this Site. By using this Site, placing an order with us, you are indicating your acceptance of the following terms and conditions (the "Terms and Conditions"). We reserve the right to make changes to this Site and these Terms and Conditions at any time.

 

Order Acceptance Policy
Payment shall be made by a credit card. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of the order or our offer to sell. We reserve the right, without prior notification, to accept or decline your order or limit the order quantity for any reason. For credit card payments, such payment is subject to the approval of the financial institution issuing the credit card and we shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason. We may require, at our option, that any order placed over certain dollar amounts receive our pre-approval. We also may require additional verification or information before accepting any order.

Sales Taxes Digital Peripheral Solutions Inc shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within California. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.

 

Electronic Communications When you visit qps-inc.com  or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You are responsible for maintaining the confidentiality of your password and for any and all activities that occur under your account and password. You agree to notify Digital Peripheral Solutions Inc immediately at cs@dpsi-usa.com of any unauthorized use of your account or any other breach of security you learn about.

 

Risk of Loss All items purchased from Digital Peripheral Solutions Inc are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

 

Jurisdiction and Venue You agree that any legal action brought against Digital Peripheral Solutions Inc Corporation shall be governed by the laws of the State of California without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Digital Peripheral Solutions Inc sites shall be an appropriate federal or state court located in Los Angeles County California.

 

 RMA POLICY 

  1. Products shipped by DPS Inc come with a limited one-year warranty.  DPS Inc warrants these products to be free from defects in material and workmanship under normal use and service for a period of one year from the date of shipment.  Any DPS Inc product that fails will be repaired, replaced with an equivalent or better component or a credit will be issued at our option.  DPS Inc makes no warranty as to the merchantability, fitness or application of the products.
  2. The DOA period is 15 days from date of invoice.   Items returned for DOA must be in original package with all accessories and supporting documentation.
  3. All claims for shortage or shipment errors must be made within 3 days upon receipt of the merchandise.  Recipient must report to freight carrier immediately when damaged boxes are received.  Risk of loss passes to purchaser upon shipment of product from DPS Inc’s facility.
  4. Customer MUST contact DPS Inc for a Return Merchandise Authorization  number to return any item.   Any item returned without the RMA number from DPS Inc will be returned.   Items returned under an RMA must be shipped prepaid with the original box and packing material.
  5. The RMA number must be clearly marked on the outside of the box and copy of the original invoice and description of the problem must be enclosed.    Any item returned without an RMA number will be REFUSED.
  6. A minimum restocking fee of 15% will be charged on any returned product which is not the result of shipping error.   No requests for refunds are accepted after 14 days.    
  7. In the event of a dispute, the venue for litigation will be in Orange County, California.
  8. Limitation of Liability.  Any liability for consequential and incidental damages is expressly disclaimed.   DPS Inc’s liability in all events is limited to, and shall not exceed, the purchase price paid. 
  9. In the event of default, the prevailing party in the legal action is entitled to recover attorney fees and court costs incurred in litigation of this matter.
